Court of Appeal accepted Uber's appeal after the injunction filed by ANTRAL.

The Court of Appeal in Lisbon considered the appeal filed by Uber following the court decision prohibiting its activity in Portugal and ordered the Civil Court of Lisbon to reassess it as “partially upheld”. We recall that the Central Court of Lisbon accepted on April 28, 2015 an injunction filed by ANTRAL (National Association of Road Transporters in Light Vehicles) and banned the services of the Uber transport application in Portugal, a decision that was confirmed by the same court in June.

Now, the Court of Appeal considered that the decision of the Civil Court of Lisbon was not reasoned and ordered the reassessment of the decision by the Civil Court of Lisbon, by asking this court to duly substantiate each of the aspects underlying its preliminary decision of the injunction. “If we pay attention, the entire reasoning was constructed in a generic way, which in the end consubstantiates everything and nothing”, reads the judgment of the Lisbon Court of Appeal. At issue are decisions of the Civil Court of Lisbon, which, according to Uber in the appeal, "not only incorrectly assessed the evidence, but also disregarded who the burden of proof falls on".

In statements to the press, Florêncio Almeida, president of ANTRAL, downplayed this request for reassessment by the Court of Appeal. “This is a request for clarification. Uber is given no reason, so there's no reason to get excited.” Another episode in the legal arm wrestling between Uber and the taxi drivers that promises not to stop there.
